PassWise

Terms of use

Last updated: 27 October 2026

These terms set out how you can use PassWise and what each of us is responsible for. We have kept them short and in plain English.

1. About these terms

These terms apply to your use of PassWise (passwise.education), run by Luke Eaton, based in Edinburgh, Scotland. “PassWise”, “we” and “us” mean the operator of the service. “You” means the teacher or tutor using a PassWise account.

By creating an account or using PassWise, you agree to these terms. Pupils and live-quiz participants use PassWise through a teacher or tutor, who is responsible for their use under these terms.

2. The service

PassWise is free to use. It lets you write and generate questions, run live quizzes, set assignments, mark work and track pupil progress across School and Tutoring workspaces.

We may add, change or remove features over time. If we make a change that significantly reduces what you can do, we will give account holders reasonable notice by email where we can.

3. Your account

  • You must be at least 18 and a teacher, tutor or other education professional to create an account.
  • Give accurate details and keep your sign-in details secure. You are responsible for activity on your account.
  • Tell us promptly at luke.eaton.mail@gmail.com if you think someone else has accessed your account.
  • You can export your data or delete your account from your settings at any time.

4. Pupil data and your responsibilities

When you add pupils to a workspace, the school (for a School workspace) or you as the tutor (for a Tutoring workspace) is the data controller, and PassWise processes that data on your behalf. Our privacy notice explains this in full.

You are responsible for:

  • having a lawful basis to add pupil data to PassWise, and following your school’s policies where they apply;
  • telling pupils and parents how their data is used;
  • in Tutoring workspaces, getting consent from a parent or carer before adding a pupil under 13;
  • adding only the data PassWise needs (a first name and an initial is enough);
  • removing pupils who no longer need to be in your workspace.

5. Your content

You own the questions, quizzes and other material you create or upload. You give us permission to store and display it so we can run PassWise for you and the pupils you share it with.

You are responsible for the content you upload. Make sure you have the right to use it, for example that you are not copying exam board papers or textbook material in a way their licence does not allow.

6. AI-generated content

PassWise can generate draft questions and suggest marks and feedback for written answers. AI output can be wrong, incomplete or unsuitable. You must review it before using it with pupils, and you remain responsible for any question you set and any mark or feedback you give. AI mark suggestions are shown only to you and reach a pupil only after you approve them.

7. Acceptable use

You must not use PassWise to:

  • upload anything unlawful, harmful, abusive, discriminatory or inappropriate for children;
  • upload more personal data than the service needs, or any special category data about pupils;
  • harass, bully or deceive anyone;
  • infringe anyone’s copyright or other rights;
  • try to access accounts, workspaces or data that are not yours;
  • disrupt, overload, scrape or reverse engineer the service, or get round its security or usage limits;
  • resell or offer PassWise as part of a paid service without our written permission.

If you see content on PassWise that breaks these rules, please report it to luke.eaton.mail@gmail.com.

8. Suspension and ending your use

You can stop using PassWise and delete your account at any time. We may suspend or close an account that breaks these terms or puts pupils, other users or the service at risk. Where it is reasonable to do so, we will tell you first and give you a chance to export your data.

If we ever decide to close PassWise, we will give account holders at least 30 days’ notice so they can export their data.

9. No warranty

PassWise is a free service provided “as is” and “as available”. We work to keep it reliable and accurate, but we do not promise it will always be available, error-free or suitable for a particular purpose. Keep your own records of anything important, such as marks needed for formal reporting.

10. Our liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

Subject to that:

  • we are not liable for indirect or consequential loss, or for loss of profit, revenue, data, time or goodwill;
  • because PassWise is free, our total liability to you for all claims connected with the service is limited to £100.

11. Changes to these terms

We may update these terms from time to time. The date at the top shows the latest version. If a change is significant, we will tell account holders by email before it takes effect. Continuing to use PassWise after that means you accept the updated terms.

12. Governing law

These terms are governed by the law of Scotland. Any dispute will be dealt with by the Scottish courts, though if you live elsewhere in the UK you may also bring a claim in the courts where you live.
